INTRODUCTION
These Terms and Conditions (“Terms”) govern all courier, freight forwarding, delivery, and sourcing services provided by SkyJet Carriers (“SkyJet”, “we”, “us”, or “our”). By using our services, creating an account, or tendering goods for shipment, you (“Customer”, “you”) agree to be bound by these Terms.
These Terms are governed by the laws of Jamaica, including but not limited to the Consumer Protection Act, Fair Competition Act, Customs Act, and regulations enforced by the Jamaica Customs Agency and relevant port and aviation authorities.
SERVICES DESCRIPTION
2.1 Air Freight Services
SkyJet provides international and domestic air freight forwarding services. Delivery timelines are estimates only and are subject to airline schedules, customs clearance, inspections, and weather conditions.
Estimated timeframe: 3–7 business days after customs clearance.
2.2 Sea Freight Services
Sea freight services include consolidated shipments and Less-than-Container Load (LCL) services where applicable.
Estimated timeframe: 14–28 business days after vessel departure.
2.3 Local Delivery Services
SkyJet provides last-mile delivery services within Kingston and Portmore.
Estimated timeframe: 1–3 business days after shipment readiness.
2.4 Sourcing Services
SkyJet may assist customers with sourcing goods internationally. SkyJet acts only as an intermediary and does not guarantee supplier performance, product quality, or availability.
CUSTOMER RESPONSIBILITIES
Customers agree to:
a) Provide accurate shipment details, including description, value, weight, dimensions, and recipient information.
b) Ensure goods are properly packaged for air or sea transport.
c) Provide all required invoices, permits, licenses, and customs documentation.
d) Comply with all Jamaican laws and SkyJet’s prohibited items policy.
SkyJet is not responsible for delays, penalties, or losses caused by inaccurate information or inadequate packaging.
COMPANY RESPONSIBILITIES
SkyJet will exercise reasonable care in handling shipments. Delivery dates and times are estimates only and are not guaranteed. Delays caused by customs, carriers, government agencies, or force majeure events do not constitute a breach of contract.
PRICING AND PAYMENT
5.1 Pricing Structure
Charges are calculated based on the greater of actual weight (per pound) or volumetric (dimensional) weight.
5.2 Additional Charges
Additional charges may include, but are not limited to:
• Processing fees
• Service charges
• Handling fees
• Storage fees
• Customs duties, taxes, and government charges
5.3 Payment Terms
Accepted payment methods include:
• Upfront payment
• Bank transfer
• Debit card
• Credit card
Net 30 payment terms are available only to approved business customers. Non-payment may result in shipment holds, additional fees, or disposal of goods in accordance with Jamaican law.
LIABILITY, INSURANCE AND CUSTOM ACT
6.1 Liability Limits
SkyJet’s maximum liability is limited to the lesser of:
• JMD $10,000 per shipment, or
• The declared value of the goods
SkyJet is not liable for indirect, incidental, or consequential losses.
6.2 Exclusions
SkyJet is not liable for:
• Customs seizures or forfeitures
• Delays beyond SkyJet’s control
• Damage caused by poor packaging OR any lost packages
• Acts or omissions of third-party carriers
CUSTOMS CLEARANCE AND CUSTOMER RESPONSIBILITIES
6.3 Customs Documentation Requirements
Customers are solely responsible for providing any invoices, receipts, permits, declarations, identification, or other documentation required by Jamaica Customs Agency or any government authority for the clearance of shipments.
Failure to provide requested documentation within five (5) business days of notification may result in delays, storage fees, administrative fees, customs penalties, or other charges imposed by authorities.
6.4 Customs Delays and Non-Compliance
Where a shipment is held by customs due to missing, incomplete, inaccurate, or unverified documentation, SkyJet shall not be liable for any resulting delays, penalties, storage charges, demurrage charges, seizures, forfeitures, or additional costs.
Any costs incurred by SkyJet to secure, process, store, transport, or clear such shipments shall be reimbursed by the customer before release of the goods.
6.5 Storage and Administrative Fees
For shipments delayed due to the customer's failure to provide required documentation, SkyJet reserves the right to charge:
• Administrative Processing Fee: JMD $2,500 per customs intervention
• Storage Fee: JMD $500 per day beginning on the sixth (6th) day after notification
• Any customs, warehouse, transportation, brokerage, or government-imposed charges incurred by SkyJet
These fees must be paid in full before shipment release.
6.6 Abandoned Shipments
Any shipment remaining uncleared for more than thirty (30) days after customer notification may be deemed abandoned.
SkyJet reserves the right, subject to applicable Jamaican laws and customs regulations, to dispose of, return, auction, or otherwise handle abandoned goods to recover outstanding charges, including freight, customs fees, storage fees, administrative fees, and related expenses.
The customer shall remain liable for any unpaid balance not recovered through such actions.
6.7 Right of Retention
SkyJet shall have a lien and right of retention over any shipment in its possession for all unpaid freight charges, customs charges, storage fees, administrative fees, and other amounts owed by the customer. Shipments may be withheld until all outstanding balances are paid in full.
6.8 Insurance
Shipment insurance is not included unless expressly requested and paid for in writing before shipment.
6.9 Claims
Claims for loss or damage must be submitted in writing within 7 days of delivery with supporting documentation.
PROHIBITED AND RESTRICTED ITEMS
SkyJet does not accept the following items, in accordance with Jamaican law and international transport regulations:
• Illegal drugs and narcotics
• Firearms, ammunition, or explosives without permits
• Hazardous or dangerous goods
• Counterfeit goods
• Currency or bearer instruments
• Pornographic or obscene materials
• Perishable goods unless approved
SkyJet reserves the right to refuse, inspect, or surrender shipments to authorities.
DELIVERY TERMS
8.1 Failed Deliveries
If delivery cannot be completed due to incorrect information or recipient's unavailability, additional delivery or storage fees may apply.
8.2 Storage Fees
Uncollected shipments may incur storage fees after 15 business days.
8.3 Unclaimed Shipments
Shipments unclaimed after 30 days may be sold, returned, or disposed of in accordance with the Customs Act of Jamaica.
FORCE MAJEURE
SkyJet is not liable for delays or failures caused by events beyond reasonable control, including but not limited to weather conditions, natural disasters, customs delays, government actions, labor disputes, port congestion, or acts of war or terrorism.
DISPUTE RESOLUTION
All complaints must be submitted in writing to [email protected].
These Terms are governed by the laws of Jamaica. All disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.
PRIVACY AND DATA PROTECTION
SkyJet collects and processes customer information in accordance with Jamaica’s Data Protection Act. Information is used solely for service delivery, billing, and regulatory compliance.
MODIFICATION OF TERMS
SkyJet reserves the right to modify these Terms at any time. Updated Terms will take effect once published on the SkyJet Carriers website.
TERMINATION
SkyJet may suspend or terminate accounts for non-payment, misuse of services, or violation of these Terms, without prejudice to outstanding balances.
REFUND POLICY
14.1 Eligibility
Refunds may be considered where SkyJet fails to provide the agreed service, excluding delays caused by external factors.
14.2 Request Procedure
Refund requests must be submitted in writing within 14 days of service completion.
14.3 Refund Method
Approved refunds will be processed via the original payment method or bank transfer within 14–30 business days.
